At Op. Dr. Erdi Özdemir Clinic, we care about the security of your personal data. This notice has been prepared in accordance with Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform, to explain how personal data collected through en.erdiozdemir.com, erdiozdemir.com, contact forms, telephone, e-mail and WhatsApp is processed.

1. Who We Are

This website and its communication channels belong to Op. Dr. Erdi Özdemir Clinic. Your personal data is carefully protected and processed by Op. Dr. Erdi Özdemir, in the capacity of data controller under KVKK, as described below.

2. Personal Data We Process

  • Identity and contact data: Name, surname, e-mail address, country code, phone number.
  • Request data: The content of messages you send via contact forms, e-mail or WhatsApp.
  • Health data (special category personal data): Complaints, previous treatments and surgeries, and photographs you voluntarily share for a preliminary consultation.
  • Transaction security data: IP address, browser and device information, website usage logs.
  • Marketing data: Website visit and interaction data collected via cookies (only with your consent).

3. Purposes of Processing

  • Receiving and evaluating your preliminary consultation, appointment and information requests, and responding to you,
  • Planning and carrying out medical diagnosis, treatment and care services,
  • Fulfilling obligations arising from health legislation and other legal regulations,
  • Responding to requests from authorised public institutions,
  • Ensuring website security and preventing spam and misuse,
  • Analysing website usage and improving our services,
  • Carrying out promotional and advertising activities, subject to your explicit consent.

4. Method and Legal Basis of Collection

Your personal data is collected electronically, partly or fully by automated means, through the contact / preliminary consultation forms on our websites, e-mail, telephone, WhatsApp and cookies.

Your personal data is processed under Article 5/2 of KVKK on the following legal grounds:

  • Processing is directly related to the establishment or performance of a contract (responding to your appointment and consultation request),
  • Processing is necessary for the data controller to fulfil its legal obligations,
  • Processing is necessary for the legitimate interests of the data controller, provided that it does not harm your fundamental rights and freedoms (website security, spam prevention).

Your health data is processed under Article 6/3 of KVKK by a physician bound by a duty of confidentiality for the purpose of medical diagnosis, treatment and care services, or on the basis of your explicit consent.

Data obtained through analytics and marketing cookies is processed only on the basis of your explicit consent.

5. Transfer of Personal Data

Limited to the purposes stated above, your personal data may be transferred to:

  • Legally authorised public institutions (the Ministry of Health and affiliated institutions, judicial and administrative authorities),
  • Healthcare institutions we cooperate with, where required by your treatment,
  • Our business partners providing website hosting, e-mail and IT services.

Transfers abroad: Some service providers used on our websites (Google Analytics and Google Maps – Google LLC; Meta Pixel and WhatsApp – Meta Platforms Inc.; Akismet spam protection – Automattic Inc.) have servers located outside Türkiye. Your data processed through these services may be transferred abroad in accordance with the conditions set out in Article 9 of KVKK.

6. Retention Period

Your personal data is retained for as long as required by the purpose of processing and for the statutory retention periods set out in the applicable legislation. At the end of this period, your data is deleted, destroyed or anonymised. Consultation and contact requests that do not result in treatment are deleted after a reasonable period.

7. Your Rights under Article 11 of KVKK

By applying to the data controller, you have the right to:

  • Learn whether your personal data is being processed,
  • Request information if it has been processed,
  • Learn the purpose of processing and whether it is used in line with that purpose,
  • Know the third parties to whom your data is transferred in Türkiye or abroad,
  • Request correction if your data is incomplete or inaccurate,
  • Request deletion or destruction of your data under the conditions set out in Article 7 of KVKK,
  • Request that correction, deletion and destruction be notified to third parties to whom your data was transferred,
  • Object to a result against you arising from the analysis of your data exclusively by automated systems,
  • Claim compensation for damages arising from unlawful processing.

8. How to Apply

You may submit your requests, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller:

  • In person or through a notary, with a wet-signed letter sent to the address above,
  • With a secure electronic signature or mobile signature, or from your e-mail address registered in our records, to info@erdiozdemir.com.

Your application must include your name and surname, nationality and passport number (Turkish ID number for Turkish citizens), address or e-mail for notification, and the subject of your request. Requests are concluded free of charge within 30 days at the latest; if the process requires an additional cost, a fee may be charged according to the tariff set by the Personal Data Protection Board.
